This Refund, Cancellation and Payment Policy (the “Refund Policy”) applies to every proposal, quotation, estimate, invoice, and Engagement between you and Pixelvise Solutions Private Limited (“Pixelvise”, “we”, “us”, or “our”). It forms part of, and is read with, our Terms of Service at pixelvise.com/legal/terms. Capitalised terms have the meanings given in the Terms.
In short: we do not give refunds. We reserve our people, time, and capacity for you the moment you accept, and we commit to meetings, planning, and purchases for your project. Read this page before you acknowledge a proposal or pay an invoice.
1. The short version
1.1All payments to Pixelvise are final and non-refundable. This includes every advance, deposit, booking amount, retainer, milestone payment, and invoice, paid in whole or in part, at every stage of an Engagement.
1.2Once you acknowledge a proposal or pay an invoice, you cannot cancel. If you stop, cancel, or abandon the project for any reason, you keep your obligation to pay and we keep everything you have paid.
1.3If you have any doubt about the scope, price, or terms, ask before you accept. Once you accept, you are bound.
2. Invoices and proposals bind you by default
2.1Every Pixelvise invoice, proposal, quotation, estimate, payment link, and receipt leads to pixelvise.com. The current Terms of Service and this Refund Policy are published there and are incorporated into each of them, whether or not they are printed on the document.
2.2You are bound by our Terms and this Refund Policy as soon as you do any of the following: acknowledge, approve, sign, or reply in agreement to a proposal or invoice, in any form including an email, message, or click; pay all or any part of an invoice or advance by any method; allow or instruct us to begin work; attend a kickoff or discovery meeting or send us a brief, content, or access; or let us begin work without objecting in writing within two (2) business days.
2.3No signature is required. Not having read the Policies is not a defence. If you accept on behalf of a company, you confirm that you have authority to do so, and if you do not you are personally liable.
3. Advances and deposits
3.1Advances are due when you accept and, unless we say otherwise in writing, before work begins. They are a booking and reservation fee for the capacity we set aside for you and the other work we decline in order to hold that capacity.
3.2Advances are earned when received. They are non-refundable, non-creditable, and non-transferable, even if work has not yet started, and even if the project is later changed, delayed, paused, or cancelled.
3.3We apply advances first to work performed. Any portion exceeding the value of work performed is retained as a reservation fee and is not refunded.
4. Work, meetings, and time already spent
4.1Discovery calls, meetings, workshops, research, proposal preparation, planning, design exploration, development, project management, and revisions are all chargeable work. We often spend months and many hours in meetings on a project, and that time cannot be recovered.
4.2Work performed is valued at our prevailing time-based rates and is not limited by a fixed fee or milestone fee. If the value of work performed exceeds your advances, the balance is payable immediately.
4.3Once work has commenced, no refund of any kind is available, whatever its stage of completion.
5. Frameworks, licences, and third-party purchases
5.1Frameworks, themes, plugins, licences, fonts, stock media, software subscriptions, domains, hosting, advertising spend, and other third-party items that we buy or commit to for your project are charged to you at cost or as quoted.
5.2These purchases are non-cancellable and non-refundable. They remain payable even if the project is cancelled, and we are not obliged to transfer them to you unless you have paid in full and we choose to do so.
6. Cancellation by you
6.1You have no right to cancel after acceptance. A cancellation request must be sent to legal@pixelvise.com and is effective only on our written acknowledgement. It does not release you from any obligation.
6.2If you cancel, stop responding, or abandon the project: (a) we keep all advances; (b) you pay for all work performed and meetings held, valued at our prevailing rates, to the extent they exceed your advances; (c) you pay all third-party costs incurred or committed; and (d) you pay a cancellation fee of fifty per cent (50%) of the unbilled balance of the total fees under the proposal, as a genuine pre-estimate of our loss from reserved capacity and foregone engagements.
6.3If you are silent or inactive for thirty (30) days, we may treat the project as cancelled by you on these terms.
7. Dissatisfaction, change of mind, and unclear briefs
7.1You are responsible for knowing what you want and for telling us clearly. We are not responsible when a client cannot articulate, represent, or decide what it wants.
7.2None of the following is a reason for a refund, cancellation, discount, rework, or withholding of payment: you do not like the design or copy; you changed your mind or your direction; your budget or business changed; a stakeholder disagrees; you found another provider; or the work did not produce the traffic, leads, sales, or results you hoped for.
7.3Revisions are limited to those stated in the proposal or, if none are stated, one consolidated round per milestone. Anything further is chargeable.
7.4Work is deemed accepted when you approve it, use or launch it, or let five (5) business days pass after delivery without a written, specific, and reasonable objection identifying a material departure from the written scope.
8. Client delays and inactivity
8.1If you do not provide feedback, materials, approvals, or payment within seven (7) days of our request, we may pause your project and release your reserved schedule. Resuming may incur a remobilisation fee and a new timeline.
8.2Delays caused by you do not extend or reduce your payment obligations, and no refund arises from the delay of a project.
9. Chargebacks and payment disputes
9.1You agree not to initiate or threaten a chargeback, payment reversal, or dispute with your bank, card issuer, UPI provider, or any payment platform for sums paid to us for services rendered or reserved.
9.2If you do, you are in material breach. You will owe the full amount plus all fees, penalties, and costs, we may submit our Terms, this Policy, your acknowledgement, and project records as evidence, we may suspend all services and withhold all work, and we may recover all sums by any lawful means.
9.3Invoice disputes must be raised in writing, with full particulars, within three (3) business days of the invoice date. An invoice not disputed within that time is conclusively accepted. A dispute never entitles you to withhold undisputed amounts or to a refund.
10. Subscriptions, retainers, and hosting
10.1Recurring fees are billed in advance, are non-refundable, and are not pro-rated.
10.2They continue until you give thirty (30) days’ written notice effective at the end of the then-current billing cycle. We provide no support, maintenance, hosting, or updates after delivery unless you have separately purchased them in writing.
11. Goodwill is our choice, not your right
11.1We may, at our sole discretion, offer a credit or goodwill gesture in a particular case. Any such offer must be in writing signed by a director of Pixelvise, is not an admission, and creates no right, obligation, or precedent for you or anyone else.
11.2If Pixelvise itself decides not to proceed with a project, other than because of your breach, we may in our sole discretion complete the work, release completed work, or credit or refund the portion of an advance attributable to work not performed. Nothing further is owed to you.
12. Fraud, abuse, and misrepresentation
12.1We may refuse service, suspend or terminate a project immediately, retain all sums received, and report matters to the relevant authorities where we suspect fraud, false identity or authority, abusive conduct, or attempts to obtain work without paying for it.
13. Relationship to our Terms and updates
13.1This Refund Policy is part of our Terms of Service. If there is any conflict between this Policy and any proposal, invoice, email, message, or other document, the provision more protective of Pixelvise prevails, unless a director of Pixelvise varies a specific clause in a signed writing.
13.2We may update this Policy by publishing a new version at pixelvise.com. Updated versions apply to new proposals and invoices and, from publication, to continuing projects.
13.3Nothing in this Policy excludes any right that cannot lawfully be excluded under applicable law.
14. Contact
14.1Questions about this Policy must be raised before you accept a proposal or pay an invoice. Write to legal@pixelvise.com. Asking a question after acceptance does not pause or reduce any payment obligation.
